Colo. Court Of Appeals Hears Ward Churchill Case

LAW WEEK COLORADO

DENVER — A three-judge panel of the Colorado Court of Appeals heard oral arguments yesterday in the case of Ward Churchill, the controversial professor fired from the University of Colorado in 2007. Churchill won a lawsuit last year to get his job back, but the jury’s verdict was set aside by Judge Larry Naves.

David Lane of Killmer Lane & Newman represented Churchill at trial and at the Court of Appeals, while CU was represented on appeal by its trial counsel, Patrick O’Rourke. The judges on the appellate panel were Dennis Graham, Gilbert Roman and Diana Terry. Audio of the oral arguments can be listened to here.

The CU regents, acting as politicians, chilled the speech of professors at the school by firing Churchill after remarks he made about 9/11, Lane said, The Denver Post reports. Churchill was fired for plagiarism, O’Rourke responded, and the school should be allowed to set its own policy.
